1. DEFINITIONS
For the purposes of these Terms and Conditions, the following definitions apply:

Terms and Conditions – this document specifying the rules for using the Website and Online Store, as well as the rights and obligations of the Service Provider and Customers.

Service Provider / Seller – Agata Knorowska conducting business under the name BRANIK studio Agata Knorowska, ul. Stradomska 43, 04-619 Warsaw, Poland, NIP: 951-206-19-66, REGON: 146196872, e-mail: shop@branikstudio.com.

Website – the website available at branikstudio.com, allowing users to browse the offer and place Orders.

Online Store – the part of the Website through which the Customer may purchase goods.

Customer – a natural person, legal person, or organizational unit with legal capacity, using the Website and/or placing an Order.

Consumer – a Customer who is a natural person entering into an agreement with the Seller for purposes not directly related to their business or professional activity.

Newsletter – commercial information sent electronically upon obtaining the Customer’s consent.

Privacy Policy – a document defining the rules for processing personal data, available at: www.branikdelight.com/polityka-prywatnosci.

Order – a Customer’s declaration of intent to purchase goods through the Online Store.

Delivery Provider – a courier company or other entity responsible for delivering goods.
2. GENERAL PROVISIONS

These Terms and Conditions set out the rules for using the Website and Online Store, including placing Orders and concluding sales agreements.

The Customer is required to read the Terms and Conditions and Privacy Policy before placing an Order.

These Terms and Conditions do not infringe mandatory provisions of law, including the Civil Code and the Consumer Rights Act.

The Seller reserves the right to restrict the sale of certain products to adults only.

All content and images on the Website are protected by copyright and belong to the Seller or its partners.

It is forbidden to provide unlawful content or use the Website for commercial purposes without the Seller’s consent.

Minimum technical requirements: a device with Internet access, an up-to-date web browser supporting JavaScript and cookies, and an active e-mail address.
3. ORDERS AND PAYMENTS

Orders are placed by adding products to the cart and clicking the “Buy and pay” button.

Before placing an Order, the Customer receives information about the total price including delivery costs.

By placing an Order, the Customer:
a) accepts the Terms and Conditions and Privacy Policy,
b) agrees to the processing of personal data for Order fulfillment,
c) may voluntarily subscribe to the Newsletter. -
Order confirmation is sent to the Customer by e-mail.

All prices are stated in Polish zlotys (PLN), include VAT, and exclude delivery costs (unless stated otherwise).

Prices may change, but this does not affect Orders placed before the change.

Order processing time: 1 to 21 business days from the date of payment confirmation, depending on the specific product and information provided in its description. Orders are delivered to the address provided by the Customer in the order form.

The Customer should check the shipment upon delivery and report any damage immediately.

Available payment methods:

bank transfer,

electronic payment (Blue Media S.A.),

payment cards (Visa, Mastercard, Maestro).

Payment deadline: 2 days from placing the Order. After this time, the Order will be canceled.
4. NATURAL STONE PRODUCTS – CHARACTERISTICS AND RECOMMENDATIONS

Products made of natural stone may contain natural imperfections (scratches, cavities, discolorations, variations in shade or texture).

Each product is unique – photos in the Store are for illustrative purposes only.

Products are impregnated with a food-safe protective agent.
-
Usage recommendations:
-
do not wash in a dishwasher,
-
clean with a damp cloth without detergents,
-
re-impregnate at least once a month,
-
avoid contact with acidic substances (citrus, alcohol, coffee, sauces).

5. WARRANTY

The Seller provides a 24-month warranty for all products purchased in the Online Store, starting from the date of delivery to the Customer.

The warranty covers physical defects resulting from causes inherent in the product at the time of its release.
-
The warranty does not cover:
a) natural characteristics of the stone (scratches, cavities, discolorations, structural or color variations),
b) mechanical damage occurring after delivery,
c) changes resulting from improper use or maintenance (including dishwasher use, detergents, lack of impregnation, long exposure to acids),
d) natural aging of the material. -
To use the warranty, the Customer must present proof of purchase and deliver the product to the Seller’s address with a description of the defect.

After reviewing the complaint, the Seller may:

repair the product,
-
replace it with a new one,
-
refund the purchase price.

Complaints are reviewed within 14 days of receiving the product.
-
Warranty rights do not exclude or limit the Customer’s rights arising from statutory warranty (rękojmia).
6. COMPLAINTS

The Seller is liable for non-conformity of goods with the contract under the Consumer Rights Act.

Complaints may be submitted:

in writing to the Seller’s address,
-
by e-mail: shop@branikstudio.com.

The complaint should include the Customer’s details, Order number, description of the defect, and contact information.
-
Complaint processing time: 14 days.
-
The Consumer has the right to repair, replacement, price reduction, or withdrawal from the contract (in the case of a significant defect).
7. WITHDRAWAL FROM THE CONTRACT

The Consumer has the right to withdraw from the contract within 14 days without giving any reason.

This right does not apply to made-to-order or personalized products.

The cost of returning the goods is borne by the Customer.
-
Refunds are made within 14 days from the receipt of the goods or proof of shipment.
8. PERSONAL DATA PROTECTION

The Seller is the administrator of personal data.
-
Data is processed in accordance with the GDPR and the Privacy Policy.

The Customer has the right to access, correct, delete, or restrict the processing of their data.
9. FINAL PROVISIONS
-
In matters not regulated herein, Polish law and EU regulations apply.

Disputes with Consumers are resolved by competent courts according to applicable laws.

The Seller may amend these Terms and Conditions in the event of legal or organizational changes — Customers will be informed in advance of any updates.
